PRIVACY DECLARATION

 I/we understand that it is necessary for NZ Business Finance Limited, its agents and business partners (collectively “NZ Business Finance”) to collect personal information to:

·       enable an accurate assessment of this loan application;

·       comply with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 and the Foreign Account Tax Compliance Act 2014;

·       enforce or defend NZ Business Finance’s rights or collect any money owed to NZ Business Finance;

·       offer a service or market a product to me/us that is either an NZ Business Finance product or a product NZ Business Finance markets or administers;

·       manage our internal operational requirements including credit and risk management, audit, insurance and funding;

·       enable the transfer of NZ Business Finance’s rights.

I/we acknowledge that if NZ Business Finance is unable to obtain the information that it requires it may not be able to assess the loan application or provide services.

I/we authorise NZ Business Finance to collect information from credit reporting agencies, the Ministry of Justice, New Zealand Transport Agency, the Department of Internal Affairs, credit providers, my/our employer(s), accountant(s), relatives, or other person(s) or agencies (“Third Party Providers”) such personal, financial and commercial information and references about me/us as is necessary for NZ Business Finance to process any loan application and to enable NZ Business Finance to comply with the law.

I/we authorise NZ Business Finance to share my/our personal information that I/we have provided to NZ Business Finance or NZ Business Finance has obtained from Third Party Providers with:

·       Third Party Providers for identification, the maintenance of accurate information, compliance with law and the assessment of this loan application

·       NZ Business Finance’s professional advisers and funders including but not limited to banks, accountants, lawyers, debt collection agencies, insurers, assignees or potential assignees

·       Finance companies at which my/our application for funding will be lodged.

I /we agree that NZ Business Finance may produce a copy of this authority to such parties to collect such information and share with them information collected. 

I/we acknowledge that if NZ Business Finance is successful in assisting me/us to secure finance, NZ Business Finance:   

•       will keep the personal information during the period the finance is provided and for the statutory term after repayment of all credit provided by the provider of finance; and

•       may lodge default information with credit reporting companies/agencies.

I/we acknowledge that if NZ Business Finance is not successful in assisting me/us to secure finance, NZ Business Finance:   

·         will keep the personal information for a period of six months to enable me/us to keep our application live

·         will destroy and/or delete any personal information held by them on my request or after a six month period. 

I/we shall have access to any personal information held by NZ Business Finance and the right to request correction.

Depending on my/our application, there may be other agencies that NZ Business Finance contacts and provides my/our personal information to in relation to my/our application. NZ Business Finance will provide the names and contacts of these agencies upon my/our request.

COMMUNICATION

I/We consent to NZ Business Finance communicating with me/us with respect to this application and the loan electronically by email, SMS and other electronic means. I/We also consent to you sending me/us marketing material and messages electronically or otherwise even after I/we have repaid our loan. I/we will contact NZ Business Finance following repayment of our loan if we withdraw this consent.
